Federal legislators may want to focus more on the de-glorification of the hoodlum/hip-hop culture. If he ever needed ammunition to take down the game industry, Rockstar (in their infinite wisdom) has just handed him a weapon more powerful than any firearm. Right now, I'm betting Senator Joe "Let's Annex the Middle East and Pump Out the Oil" Lieberman must be rolling on the floor with glee.
This bodes ill for the wworld's largest market of home game consoles - Japan may be leaders in game innovation, but they make up a fraction of the global game market. Interesting games like Killer 7 with mature content may be held up or censored for the U.S.
More Federal regulation may mean a shift in how developers may tailor their products. However, a videogame is still viewed much as a child's toy (albeit an expensive one). government may still be able to have a hand in regulating the ESRB (thereby influencing what may get published on future gaming decks) - it's not censorship, since individuals over 18 may still purchase and partake of M and AO rated games. Push too much to clamp down on the ability to express one's self through the arts and entertainment, and it's infringement of the First Amendment. Federal regulation, while much welcome in essential businesses (i.e., land use, water and energy management, communications management, etc.) are less welcome in non-essential businesses such as private entertainment, the arts, and the like. Federal legislators are up in arms and seem quite intent on having regulating powers on the ESRB. Hindsight though, makes one believe that Rockstar's management is (A) dumber than a box of cat litter, or (B) designed this ploy as a marketing ploy that backfired. What possibly could've possessed Rockstar's decision makers to allow the inclusion of this contreversial module is unknown. Here's where those who understand the business and those who don't get cut out like cancer - hackers are quite capable of breaking apart even the most complex security measures in software. Unfortunately, whatever train of thought Rockstar's management possessed apparently did not foresee this unused module coming back to haunt them. Unlike the male-male kissing party SimCoptor a few years back, the "Hot Coffee" with GTA San Andreas did not seem to be the result of a lone frustrated programmer, but it was designed as part of the original game (this is called 'shooting the shit' in most developer meetings). GTA's current conundrum stems from a lax attitude on the part of Rockstar for leaving an unused but supposedly fully playable subroutine whereby CJ (the game's protagonist) may have sexual intercourse with various women in the game (at least one who was/will be killed in GTA3). However, few individuals outside the hard-core gaming community understand what games ultimately allow people to experience. Games are considered as our most lurid outlet of virtual interactivity ever since pen and paper RPGs fell victim to the cathode ray tube, intern?). For many game players, the concept of being able to interact with a quasi-realistic setting (i.e., The Sims, SimCity, various FPS titles) frees one from the daily constraints of morality and reality. One cannot say the replication of reality isn't enticing.

Rarely does one see any American developer pull this stunt off (except for shabby PC shovelware) but Rockstar has managed to do so on two of the largest home consoles in the market today.
That's quite an accomplishment for a game that has done much in defining a quasi-realistic world, but lacks serious depth in actual play variety. Face facts please - Rockstar managed to remake Grand Theft Auto III twice in the past three years.
